Payday AI: Terms of Service

By connecting to or using the Payday AI service you ("you", "the user") agree to these Terms. If you do not agree, do not connect to or use the service.
1. What Payday AI is
Payday AI is a subscription information service, sold and delivered through our own website. It is a directory of named businesses built by solo founders and tiny teams. Each business's page shows the money figures its own founder has reported, with the source and date, plus Payday AI's own independent estimate, shown as a range with the workings behind it. We never reduce a figure, an estimate, or a business to a letter grade or score of any kind.
Key points about how it works:
- Seven pages are free; everything else is for subscribers. Without paying or creating an account, anyone can read in full: Cal AI's company page; three trend pages (AI image recognition, Calorie tracking, and Weight loss); and three growth-tactic pages (Influencer partnerships, UGC, and Price testing). The Companies, Trends, and Growth pages, which list every business, trend, and growth tactic, also show those same rows in full. Every other page and row needs an active paid subscription to see its figures and details. There is no free subscription plan. See section 4.
- The AI-assistant connector is a paid-subscriber benefit, not a separate product. If you have an active paid subscription, you can also connect Payday AI to your own AI assistant or agent (for example Claude, ChatGPT, or another MCP-capable client) using the Model Context Protocol (MCP). Once connected, it personalises what it shows you inside that conversation.
- We rank which businesses appear first in your briefing. When the per-member briefing is available to your membership, Payday AI ranks eligible businesses on our server. It uses your current saved companies and the confirmed skills, assets, interests, goals, strengths, constraints, and dislikes in the graph stored for your membership. A confirmed constraint or dislike can lower a business's position, and a confirmed rule against an industry or type of customer can exclude it. We also use the record of businesses already returned or shown so they are not presented as fresh discoveries. Payday AI does not receive your conversation itself or run an AI model over it. Your assistant performs any broader interpretation inside your own AI client, on your own AI usage or tokens, under your client provider's terms.
- Graph links are encrypted and short-lived. When the connector makes a hosted graph link, it sends the display graph to Payday AI over HTTPS. Payday AI encrypts it and keeps the ciphertext for about 72 hours. The decryption key stays after the
#in the link, which browsers do not send in an HTTP request. Separately, Payday AI's connector instructions tell your assistant not to ask you and to send the fuller working graph for storage as part of your membership at the end of onboarding and after changes. See the Privacy Policy for the exact data and retention rules. - You need your own AI client to use the connector. Payday AI is not itself an AI assistant and does not provide one. A compatible MCP client and any associated AI subscription are your responsibility and are governed by that provider's terms and pricing, not ours. The connector is only available to subscribers through our own website. It is not distributed through any AI assistant's app store or marketplace.
2. Not financial, investment, legal, tax, or professional advice
This is the most important thing to understand about the service.
- Payday AI provides general information and ideas for research and inspiration only. It is not financial advice, investment advice, legal advice, tax advice, accounting advice, or any other kind of professional or personal advice, and nothing in the service should be treated as a recommendation to start, buy, sell, or invest in any business, product, security, or asset.
- We do not know your personal financial situation, objectives, or needs. The per-member briefing ranks directory businesses using the saved companies and confirmed graph sections described above. Your own agent may perform broader personalisation. Neither kind is advice.
- We are not a licensed financial services provider and do not hold an Australian Financial Services Licence. Ideas that touch on investing, trading, or financial products are described as general information only.
- Before acting on anything you find through Payday AI, get your own independent, licensed professional advice (financial, legal, tax, and/or accounting as relevant) suited to your own circumstances.
3. No income guarantees or results promises
- The revenue figures, evidence, and trend data in the service describe other people's or third parties' reported results, at a point in time, from public sources, plus Payday AI's own independent estimate, shown as a range with our workings. None of this is a prediction, projection, promise, or guarantee of what you will earn.
- Your results depend on you: your skills, effort, timing, market conditions, capital, and many factors outside anyone's control. Most new ventures earn little or nothing and many fail. Nothing in the service should be read as a promise of income, profit, or success.
- Figures are sourced from third parties, or estimated independently by us, and despite our sourcing and honesty checks, may be inaccurate, incomplete, out of date, or unverifiable. We label how fresh a figure is and where it came from, but do not warrant the accuracy of any figure, including our own estimate. We never reduce a figure or an estimate to a letter grade or score of any kind. Treat every figure as a claim to verify yourself, not a fact to bank on.
4. Subscriptions, pricing, and payment
- One plan. No free tier. Payday AI has a single paid plan: US$30 per month (or the then-current published price), billed in advance on a recurring monthly basis. There is no free subscription plan of any kind.
- The seven free pages are not a subscription tier. Cal AI's company page, its three trend pages, and its three growth-tactic pages (named in section 1), plus the matching free rows on the Companies, Trends, and Growth pages, are a feature of the public website, not a free plan of the service, and none of it includes the AI-assistant connector. Only an active paid subscription gives you every other page and row, and the connector.
- Who you are buying from, and who handles the charge and its tax. Payday AI is sold through Stripe Managed Payments. Stripe is the merchant of record for your payment: the charge, the receipt, and any GST, VAT or other tax on it come from Stripe, and Stripe remits that tax, the same arrangement described in the Privacy Policy, section 2.1. Arthur Felix Pty Ltd operates the Payday AI service you are subscribing to, and is who you are contracting with for the service itself.
- Billing authority: by subscribing you authorise Stripe to charge your chosen payment method the subscription fee each billing period until you cancel.
- Price changes: we may change prices. We will give you reasonable advance notice of any increase, and it will take effect from your next billing period; you may cancel before it applies.
- Payment data: card and payment details are handled by Stripe. We do not see or store full card numbers. See the Privacy Policy.
- Failed payments: if a payment fails, access to paid features may be suspended until payment succeeds.
5. Cancellation and refunds (Australian Consumer Law)
- Cancel any time. Email support@thepayday.ai and we will cancel your subscription. Most members can also do it themselves: sign in, open your account page, and if a Manage billing button is shown under Billing, it takes you to Stripe's billing portal to manage or cancel your subscription there. Either way, cancelling stops future renewals.
- What happens on cancellation: you keep paid access until the end of the billing period you have already paid for; we do not, as a general rule, pro-rate or refund the unused part of a paid month simply because you changed your mind, except for the first month's money-back window described below (but see your legal rights below too).
- Your rights under the Australian Consumer Law are not excluded. Our services come with consumer guarantees that cannot be excluded under the Australian Consumer Law (ACL). Among other things, services must be provided with due care and skill, be reasonably fit for any purpose you told us about, and be supplied within a reasonable time if no time was agreed. If a service has a major problem, you may cancel and receive a refund for the part not properly provided, or keep the contract and receive compensation for its reduced value. If a minor problem is not fixed within a reasonable time, you may have another supplier fix it and recover the reasonable cost, or cancel and seek a refund or compensation for reduced value. You may also claim compensation for reasonably foreseeable loss caused by a failure. The remedy depends on the circumstances. Nothing in these Terms limits or removes those rights. - How to raise a problem: contact support@thepayday.ai describing the issue. We aim to respond within a few business days and to work with you in good faith to put things right.
- First month, money back. If it is not what you expected, email support@thepayday.ai within 30 days and we refund the first month. No form, no questions. This is a voluntary offer on top of, not instead of, your rights under the Australian Consumer Law above. It is an additional contractual promise and does not limit your ACL rights. 6. Fair use and acceptable use
Payday AI content is for your personal use only and may not be redistributed.
The service is priced and built for individual, good-faith use by one subscriber. To keep it fast and sustainable for everyone, you agree not to:
- scrape, bulk-download, harvest, or systematically extract the business or trend directory, or any substantial part of it, whether manually or via scripts, agents, or automation beyond ordinary personal use of the service;
- make more than 400 Payday AI data-tool calls per membership in one UTC day. Calls that later error still count. The limit resets at midnight UTC and does not apply to your daily drop or, when available to your membership, your per-member briefing;
- share, resell, sublicense, or redistribute your access, your access token, or our content to others, or use one subscription to serve multiple people or an organisation;
- attempt to circumvent the entitlement gate, access token, paywall, or any access control, or access paid features without a current paid subscription;
- use the service to build, train, or seed a competing product or dataset;
- probe, attack, overload, or disrupt the service or its infrastructure, or attempt to gain unauthorised access; or
- use the service for anything unlawful, or in breach of any third party's rights or of your AI client provider's terms.
We may apply reasonable technical limits, and may warn, throttle, suspend, or terminate access for conduct that breaches this section, with notice where practicable.
7. Intellectual property: our content vs your outputs
- Our content stays ours. The business and trend directory, curation, editorial framing, our independent estimates and workings, our sourcing and honesty checks, trend analysis, page content, branding, and the compilation as a whole are owned by Arthur Felix Pty Ltd or our licensors and are protected by copyright and other laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use our content for your own internal research and venture-building while your subscription is active. No other rights are granted.
- Underlying facts. Individual facts, figures, and events described in the service are drawn from public third-party sources and are not owned by us; our rights are in the selection, arrangement, expression, and added analysis, not in the underlying facts.
- What you make is yours. Any business you build, plan you write, code your agent generates, or output your own AI produces using ideas or information from Payday AI is yours. We claim no ownership of, and no royalty or equity in, businesses or outputs you create. Ideas themselves are not exclusive. The same idea may be served to, and acted on by, many subscribers, and we make no promise of exclusivity or non-competition.
- Feedback. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them to improve the service, with no obligation to you.
8. Third-party dependencies and availability
- Payday AI depends on third-party platforms, including your AI client, MCP protocol behaviour, our hosting provider, and our payment processor, none of which we control and any of which may change or fail.
- We do not offer scheduled or background delivery. Payday AI answers your assistant when your assistant asks it something. If your own AI client has a scheduling or "routines" feature and you choose to use it, that is your client's behaviour and your client provider's responsibility, not a Payday AI feature, and we make no promise about whether or when it runs.
- We aim for high availability but do not guarantee uninterrupted or error-free service and may perform maintenance, updates, or changes to features from time to time.
9. Disclaimers and limitation of liability
- To the maximum extent permitted by law, the service and all content are provided "as is" and "as available", and we exclude all warranties, representations, and conditions not expressly stated in these Terms.
- Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. This clause is subject to those rights.
- Where we are permitted by law to limit our liability for a failure to comply with a consumer guarantee, our liability is limited, at our option, to re-supplying the service or paying the cost of having it re-supplied. For a subscription, this means giving you the affected service again or paying the reasonable cost of obtaining an equivalent replacement service.
- To the maximum extent permitted by law, we are not liable for business, trading, investment, or financial decisions you make; lost profits, lost revenue, or lost opportunity; the accuracy of third-party figures; the acts of third-party platforms; or indirect or consequential loss. You act on ideas at your own risk and cost.
- To the maximum extent permitted by law, the most we will pay for all claims connected with Payday AI is the subscription fees paid for Payday AI in the 12 months before the incident that caused the claim, whether Stripe or another merchant collected those fees. This limit does not apply where the law does not allow us to limit liability.
10. Suspension and termination
- You may stop using and cancel at any time (section 5).
- We may suspend or terminate your access if you materially breach these Terms (including the fair-use section), if required by law, or if we discontinue the service. We will give reasonable notice where practicable and, where we discontinue a paid service you have pre-paid for, deal with any unused paid period consistently with the ACL.
- If Stripe tells us that a charge was refunded or that a payment dispute was opened, our code immediately removes paid access. A lost dispute leaves access removed. If Payday AI wins the dispute, the code restores access only when that dispute caused the removal and the subscription is still otherwise entitled to access.
- Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) survive.
11. Changes to these Terms
We may update these Terms from time to time. If we make a material change we will take reasonable steps to notify you (for example by email or an in-service notice) before it takes effect. Continued use after the effective date of a change means you accept the updated Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that place. This does not deprive you of any protection you have under mandatory consumer law in your own place of residence.
13. General
- If any provision is unenforceable, the rest remain in effect.
- These Terms, plus the Privacy Policy and any published plan/pricing details, are the whole agreement between us about the service.
- You may not transfer your rights under these Terms; we may assign them (for example if the business is sold) on notice.
